Judge Extends Ban On Indian Cigarette Tax Collection
(Buffalo, NY) -- A federal judge has extended an order banning the state from collecting cigarette taxes from two Western New York Indian tribes. The ban is now in effect at least until the next court date on the 14th. It was set to expire on the 13th. The order only applies to the Seneca and Cayuga Nations because they are directly involved in this lawsuit, however a state judge has banned the tax collection from all of the tribes in New York. An appellate panel of judges in Rochester is expected to hear that case tomorrow. The state is hoping to charge wholesalers the four-35 per pack before the shipments even get to the reservations. Governor Paterson says the move cold generate 200-million dollars per year. Indian tribes say it violates their sovereignty. |
