State Judge Blocks Collection Of Indian Cigarette Taxes
(Rochester, NY) -- New York State has been dealt another blow in its effort to collect taxes on some Indian cigarette sales. A state appellate court judge has indefinitely barred the state from enforcing the tax on Indian sales to non-Indian customers. This follows a similar ruling Monday from a federal judge who put a temporary hold on the effort for up to two weeks for the Seneca and Cayuga nations. A spokeswoman for Governor Paterson says the state is backing off its effort to collect the tax from any tribe in the state in compliance with the latest ruling. The last time the state tried to collect the tax was back in the 1990s. That effort led to protests from Native American groups including burning tires on the Thruway. Governor Paterson says he wants to enforce the tax to try and fill 200-million dollars a year in revenue. |
